Handymigo – Customer Terms of Service

1. Introduction

Welcome to Handymigo ("Handymigo," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Handymigo website, mobile application, and related services (collectively, the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.


2. Nature of the Platform

Handymigo operates an online marketplace that connects customers with independent third-party service providers ("Providers") who offer services such as snow removal, lawn care, and home maintenance.

Handymigo is not itself a contractor, service provider, or employer of Providers. Providers are independent contractors solely responsible for their work, tools, insurance, and compliance with applicable law.

You acknowledge and agree that:

  • Handymigo does not supervise, control, or direct Providers' work or schedules.
  • Handymigo makes no warranties or representations about Providers' skills, qualifications, licensing, insurance, or background.
  • Any service contract exists only between you and the Provider.
  • Handymigo is not a party to any agreement for services.

Independent Contractor Clarification: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between Handymigo and any Provider. Providers decide when, where, and how to perform work and supply their own tools and materials.

Background-Check Disclaimer: Handymigo may, but is not obligated to, verify identities, backgrounds, or insurance of Providers. Any such verification is provided "as-is" and does not guarantee safety, reliability, or performance.


3. Account Registration and Security

  • You must be at least 18 years old to use the Platform.
  • You agree to provide accurate, current information and keep it updated.
  • You are responsible for all activity under your account.
  • Notify Handymigo immediately of any unauthorized access or suspected breach.

Handymigo may suspend or terminate accounts suspected of fraud, misuse, or illegal conduct.


4. Use of the Platform

4.1 Service Requests

You may request services by submitting accurate details and photos. You authorize Handymigo to share your request and location data with Providers for the purpose of matching and service delivery.

4.2 Provider Selection

Provider suggestions are informational only. You alone select and engage Providers, and you are responsible for evaluating their suitability, pricing, and availability.

4.3 Prohibited Conduct

You agree not to:

  • Use the Platform for unlawful purposes.
  • Misrepresent your service needs or payment intent.
  • Circumvent the Platform to hire Providers outside an active posting.
  • Harass, threaten, or abuse any Provider or user.
  • Use bots, scrapers, or other automated systems to extract data.

5. Payments

5.1 Direct Payments

Unless otherwise stated, payment for services is made directly between you and the Provider. Handymigo does not currently process or hold customer funds.

5.2 Disputes

Any dispute regarding pricing, completion, or performance must be resolved directly with the Provider. Handymigo is not a party to such disputes but may, at its discretion, facilitate communication.

5.3 Future Payment Processing

If Handymigo later enables in-app or credit-card payments, separate payment terms and transaction fees will apply. Notice will be provided before implementation.


6. Cancellations and Rescheduling

  • You may cancel or reschedule according to the individual Provider's policy.
  • Late cancellations may incur fees set by that Provider.
  • Handymigo is not responsible for refunds, penalties, or damages resulting from cancellations or rescheduling.

7. Service Performance

  • Providers are solely responsible for completing services.
  • You must provide safe, lawful access to your property.
  • You may be asked to confirm completion or leave feedback.
  • Handymigo does not guarantee timing, quality, or outcome of any service.

8. Disclaimers and Limitation of Liability

8.1 Platform Disclaimer

The Platform and its content are provided "AS IS" and "AS AVAILABLE."Handymigo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:

  • The Platform will be uninterrupted or error-free;
  • Providers will be available, licensed, insured, or reliable;
  • Services will meet your expectations or be error-free.

Provider Information: Provider profiles, ratings, and reviews are user-generated. Handymigo does not guarantee their accuracy or completeness.

8.2 Limitation of Liability

To the fullest extent permitted by law:

  • Handymigo is not liable for property damage, personal injury, death, loss, or any harm arising from services performed by Providers.
  • Handymigo's total aggregate liability for any claim shall not exceed the amount (if any) you paid directly to Handymigo in the twelve (12) months preceding the claim.
  • Handymigo shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, even if advised of the possibility.

Waiver of Liability: You expressly waive and release Handymigo from all claims arising from injury, death, or property damage occurring before, during, or after any Provider's service, regardless of cause.

8.3 Indemnification and Hold Harmless

You agree to defend, indemnify, and hold harmless Handymigo and its officers, directors, employees, agents, and affiliates from any and all claims, losses, damages, liabilities, costs, or expenses (including attorney fees) arising out of or related to:

  • Your use of the Platform;
  • Your contracts or interactions with Providers;
  • Your violation of these Terms or any applicable law; or
  • Injury or damage on your property during a service.

This obligation includes third-party claims (including those by Providers, neighbors, or guests) and Handymigo's reasonable attorney fees.

8.4 No Insurance or Warranty

Handymigo provides no insurance for Providers or Customers. If insurance is important to you, verify that your chosen Provider maintains adequate coverage. Handymigo is not responsible for uninsured or underinsured losses.


9. Safety and Property Access

  • You are responsible for ensuring safe entry and removing hazards such as ice, pets, or obstacles.
  • Handymigo is not responsible for theft, breakage, or loss.
  • You permit Providers to enter your property at your own risk.

10. Privacy

Use of the Platform is governed by the Handymigo Privacy Policy, which explains how we collect, use, and share information. By using the Platform, you consent to receive service-related notifications via email, SMS, or in-app messages. You may opt out of marketing messages but not of essential service communications.


11. Intellectual Property

All software, design, trademarks, and content on the Platform are owned by Handymigo. You may not copy, modify, reverse-engineer, or distribute them without written consent. You retain ownership of content you upload but grant Handymigo a non-exclusive license to use it for Platform operation and improvement.


12. Dispute Resolution and Governing Law

12.1 Mandatory Arbitration

Except for small-claims matters, any dispute between you and Handymigo shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Cook County, Illinois, or another mutually agreed location, and shall be governed by the Federal Arbitration Act (FAA). You and Handymigo waive any right to a jury trial or to participate in a class, collective, or representative action.

12.2 Governing Law

These Terms and any dispute shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

12.3 Time Limit

Any claim against Handymigo must be filed within one (1) year after the cause of action accrues, or it is permanently barred.


13. Termination

Handymigo may suspend or terminate your account for violation of these Terms, misuse, or illegal activity. Termination does not relieve you of payment obligations for completed or scheduled services. Provisions relating to limitation of liability, indemnification, and arbitration shall survive termination.


14. Modifications

Handymigo may modify these Terms at any time by posting an updated version on the Platform with a new effective date. Material changes will be notified by email or in-app notice. Your continued use after such notice constitutes acceptance of the revised Terms.


15. Force Majeure

Handymigo shall not be liable for delays or failures caused by events beyond its reasonable control, including severe weather, natural disasters, labor disputes, power or internet outages, or governmental actions.


16. No Third-Party Beneficiaries

These Terms are solely between you and Handymigo. No Provider, contractor, or other third party shall have any right to enforce or rely on them.


17. Severability and Survival

If any provision of these Terms is found unenforceable, that provision shall be modified only to the extent necessary to make it enforceable, and all remaining provisions shall remain in effect. Sections relating to indemnification, limitation of liability, and dispute resolution will survive termination or expiration.
